Welcome to Devlogify. These Terms of Service ("Terms") govern your use of devlogify.com and our AI receptionist services ("Services"). By accessing or using our Services, you agree to be bound by these Terms.
1. Services Description
Devlogify provides AI-powered voice receptionist services for service businesses, including:
- 24/7 automated call answering
- Lead qualification and capture
- Appointment booking and scheduling
- Emergency call routing
- CRM integration
- Call transcripts and analytics
2. Account Registration
To use our paid Services, you must:
- Provide accurate and complete information
- Be authorized to enter into agreements on behalf of your business
- Maintain the security of your account credentials
- Be at least 18 years old
3. Subscription Plans and Billing
Plans: We offer Standard ($497/mo), Pro ($997/mo), and Enterprise ($1,997/mo) plans, each with respective setup fees.
Billing:
- Setup fees are billed upon contract signing
- Monthly fees are billed in advance
- Payment methods include credit card and ACH transfer
- Failed payments may result in service suspension
Plan Changes:
- Upgrades take effect immediately (prorated)
- Downgrades take effect at next billing cycle
- Cancellations require 30-day written notice
4. Call Volume and Overage
Each plan includes a monthly call allotment. Calls exceeding your plan are billed as overage:
- Standard plan: $1.50 per additional call
- Pro plan: $1.25 per additional call
- Enterprise plan: Unlimited (no overage)
We will notify you when reaching 80% of your plan's call volume.
5. 7-Day Setup Guarantee
We guarantee deployment within 7 business days of contract signing. If we miss this deadline, your setup fee will be refunded in full. The guarantee covers:
- Custom voice training
- CRM integration
- Calendar/SMS configuration
- Live call deployment
The guarantee does not apply if delays are caused by client-side dependencies (e.g., delayed CRM credentials).
6. Acceptable Use
You agree NOT to:
- Use our Services for illegal activities
- Attempt to reverse engineer or copy our AI technology
- Interfere with the operation of our Services
- Resell our Services without authorization
- Use Services for telemarketing, fraud, or harassment
- Violate any applicable laws (TCPA, GDPR, CCPA)
7. Intellectual Property
All Services, including AI models, software, and content, are owned by Devlogify or its licensors. You receive a limited, non-exclusive license to use the Services during your subscription.
Call recordings and transcripts generated for your business are owned by you, but we retain rights to use anonymized data for service improvement.
8. Data and Privacy
Use of our Services is subject to our Privacy Policy. By using the Services, you consent to call recording and data collection as described in the Privacy Policy.
You are responsible for:
- Notifying callers of recording (where legally required)
- Compliance with applicable privacy laws
- Obtaining necessary consents from your customers
9. Service Availability
We strive for 99.5% uptime but do not guarantee uninterrupted service. We are not liable for:
- Scheduled maintenance
- Third-party platform outages (Vapi, Twilio, etc.)
- Force majeure events
- Internet connectivity issues
10. Limitation of Liability
To the maximum extent permitted by law:
- Our total liability is limited to the fees paid in the preceding 12 months
- We are not liable for indirect, consequential, or punitive damages
- We are not liable for lost profits or business opportunities
11. Indemnification
You agree to indemnify Devlogify from claims arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any third-party rights
- Your customer interactions
12. Termination
We may suspend or terminate your account for:
- Non-payment
- Violation of these Terms
- Fraudulent or illegal activity
- Extended inactivity
Upon termination:
- You retain access to your call data for 30 days
- Unused setup fees are non-refundable (except per Section 5)
- All licenses and access rights end
13. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email at least 30 days before taking effect.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law provisions.
15. Dispute Resolution
Any disputes will be resolved through:
- Good faith negotiation
- Mediation (if needed)
- Binding arbitration (final resort)
You waive the right to class action lawsuits.
